“Burger King” has legal proceedings for the domain in the .RU zone

Entering to the Russian market of “Burger King” – fast-food network that is also a competitor of McDonald's is postponed till 2010 because of Internet. Burger King Corporation has legal proceedings with the Russian and the Dutch because of the domain burgerking.ru, reported the Kommersant.

Burgerking.ru domain, that is rather predictable has become a subject of desire of “Burger King” is owned by “Elvis – Telekom” JSC and the Dutch company Talco Aktiengesellschaft. The domain name was registered in far 2000 when owners of the fast-food network even did not think about expansion to Russia.

Even though, now “Burger King” tries to win back its good name in Internet. In the beginning the company tried to do this by a peaceful way (by means of buying the domain), but it did not work out.

That’s why Burger King Corporation filed a suit to the Moscow Arbitration Tribunal against the Russian “Elvis – Telekom” JSC and the Dutch company Talco Aktiengesellschaft in the categories: “about protection patent rights” and “illegal use of trademark”. The suit was filed on November 30, 2009.

According to experts’ opinion, sellers of burgers have good chances to win at the court and get not only the desirable domain free of any charge, but also a compensation in amount up to RUB 5,000,000. Burger King registered its trademark in Russia in 1994 and according to the part 4 of the Civil Code of the Russian Federation, trademark owner has exclusive rights to the domains with the same name.
